The vandalism of the red book did not appear in the findings of the Joint Fact-Finding Team, although it was once suspected as one of the motives for the attack by the Corruption Eradication Commission investigator Novel Baswedan. Some parties have questioned it. The IndonesiaLeaks team obtained video recordings of surveillance cameras when the damage occurred and tried to trace it to several other things that happened before and after the Novel attack.
The head of the Corruption Eradication Commission (KPK), Saut Situmorang, doubled in time IndonesiaLeaks shows a video recording of the collaborative room surveillance camera (CCTV) on the 9th floor of the KPK Investigation Directorate, Jakarta. In the 1 hour 48 minutes 58 seconds video, the alleged vandalism of the red book was recorded as evidence of the bribery case for judicial review of the Animal Husbandry and Animal Health Law.
"I've never seen this," said Saut when shown the CCTV footage by the team IndonesiaLeaks in August 2019. Even so, he did not deny the odd actions of a number of investigators took place at the KPK building.
From the CCTV footage received IndonesiaLeaks, the KPK collaboration room on Friday, 7 April 2017 night was used by several investigators, including Ardian Rahayudi, Roland Ronaldy, and Harun.
IndonesiaLeaks trying to confirm the recording to Ardian, who was recorded handing the red book to Harun. However, the person concerned refused to extend the sentence.
"Just like this, you clarification to the institution. Because it is the KPK's business. It is no longer my personal business, ”said Ardian, Tuesday, October 15 2019.
Meanwhile, two former KPK investigators from the Police, Roland and Harun were caught examining a red book, had time to sit with their backs to the CCTV, and ducked behind a table. It was this gesture that led them to do it destruction of evidence by tipping and tearing the records of financial transactions containing the name Tito Karnavian.
In one scene at 01.33.47 minute, Roland takes books and objects resembling pens from the table. After that, he ducked for about two minutes. This 2001 graduate of the Police Academy then put one of the books in a plastic bag, before throwing the evidence back on the table.
Harun who sat next to Roland did not remain silent. After engaging in conversation, he unpacked the plastic package to double-check it while crossing out some parts of the information listed in the book. He also removed the marks that stuck to the edge of the financial records one by one. This strange action was recorded from 01.35.48 to 01.37.07.
IndonesiaLeaks had written to submit an interview request to Harun regarding the alleged vandalism of the red book, but the letter was never replied to. He was also met near his residence in the Palmerah area, Jakarta.
"Stop it, not it is necessary, "said Harun at the time.
Meanwhile, Roland was the one who was met IndonesiaLeaks in Cirebon, he asked that the red book vandalism case not be discussed again.
"Ah, this is a secret matter, what are you doing I'll be asked again, "he said in mid-June 2018.
Three days before the destruction of evidence, on April 4 2017 at around 20.00 WIB, KPK investigator Novel Baswedan met National Police Chief Tito Karnavian at the National Police's official residence on Jalan Patimura, South Jakarta. The meeting was attended by a number of high-ranking police officers and KPK employees who handled the Basuki Hariman case.
During the meeting, Novel wanted to clarify a number of issues that were swirling within the police regarding the formation of a Task Force targeting National Police Chief Tito, as well as asking the police to provide security to KPK investigators. The request seemed useless, because three hours later, the laptop of KPK investigator Surya Tarmiani was stolen on his way home from Yogyakarta at around 23.00 WIB.
"I think it (issue-red) inconsequential. The speech inconsequential. So to clarify, because basically the KPK works objectively. There is nothing else like targeting people, ”said Novel, August 5, 2019.
During the meeting, Novel also emphasized that he was not involved in handling the red book case that dragged Tito's name.
"I'm not that team," said Novel.
The KPK chairman, Saut Situmorang, confirmed Novel's statement. According to him, the red book case in the bribery case for judicial review of the Animal Husbandry and Animal Health Law was not handled by Novel. Because at the same time, he said, the KPK was focusing on exploring the electronic KTP case.
“I think he's not in that team either. That's a case of importing meat, "said Saut.
Based on the investigation warrant signed by the Deputy Chairperson of the KPK, Laode Muhammad Syarif on January 26, 2017, there are dozens of investigators in charge of handling the bribery case for judicial review of the Animal Husbandry and Animal Health Law. The name of the novel is not in it.
IndonesiaLeaks He has tried several times to confirm the matter of the April 3 meeting to the National Police Chief, General Tito Karnavian, on several occasions. However, he did not give interview sessions to journalists. An interview request was also sent on August 28, 2019 at around 13.13 WIB. Apart from a receipt from the General Secretariat of the Police Headquarters, no other response was received.
The red cover book of financial records should be important evidence for the KPK in order to develop the bribery case of former Constitutional Court Judge Patrialis Akbar. However, since October last year, the Metro Jaya Regional Police, with the permission of the South Jakarta District Court, have confiscated it.
The submission of this book stems from a KPK report regarding the destruction of evidence allegedly committed by AKBP Roland Ronaldy and Kompol Harun on April 7, 2017. According to KPK spokesman, Febri Diansyah, his institution has enforced ethics and discipline against Roland and Harun through the KPK Internal Supervisor. However, the process was not complete, because both were withdrawn to the original institution, the Police.
The police assumed that the two of them had finished in the middle of an internal KPK examination. Therefore, the KPK can no longer process the case under Article 21 of Law Number 31 Year 1999 concerning Eradication of Corruption Crimes.
“KPK as a law enforcement institution cannot possibly work outside the law. That's why the confiscation was carried out. The case is the alleged act of obstructing the case handling process, which happened in April 2017 at the KPK building. How is it going? we have not received any more information, ”said Febri.
A year after the confiscation of evidence, the red book scandal was brought up again after a team of experts who were members of the Joint Fact Finding Team (TGPF) for the Novel Baswedan case formed by the National Police Chief visited the anti-corruption agency office in April 2019. They want to confirm a number of motives that are suspected of being the basis for the violent water attack on Novel. This is because the Novel's attack occurred four days after the red book was destroyed, April 11 2017.
The attack, which was carried out on a motorcycle, took place after Novel was having morning prayers at the Ihsan Mosque, Kelapa Gading, North Jakarta. As a result, the eyes of the former Head of the Bengkulu Police Detective and Criminal Unit were almost blind. In fact, Novel's left eye was severely damaged by 95 percent, so he had to undergo repeated medical treatment in Singapore.
It took four months for the police to successfully sketch the face of the suspected perpetrator based on witness testimony. Since then, the investigation into the Novel case seemed to drag on until the National Police Chief, Tito Karnavian formed the TGPF in early 2019. It has 65 members consisting of 6 KPK representatives, 7 expert representatives and the rest 52 from the Police.
Some of the names of representative figures from experts in this joint team are the former Deputy Chairman of the KPK for the February-December 2005 period, Indriyanto Seno Adji, a professor at the Faculty of Law UI. There are also Hermawan Sulistyo from the Indonesian Institute of Sciences (LIPI) and a number of human rights activists, such as the Chairperson of the Setara Institute Hendardi, former Executive Director of Imparsial Poengky Indarti, and former Komnas HAM Commissioner 2007-2012, Ifdhal Kasim.
In a meeting on the 15th floor of the KPK building, one of the TGPF members who was also a former KPK leader, Indriyanto Seno Adji, according to Novel, had mentioned that the red book case was one of the cases suspected of being the cause of the violent water attack against him. In fact, there was a suspicion that the perpetrator came from the police. Suddenly this information shocked the KPK leadership.
"There is a connection between the red book being mentioned there (KPK-red) and it specifically mentions it (the Red Book case)," Novel Baswedan told IndonesiaLeaks on August 5, 2019.
IndonesiaLeaks repeatedly contacted Indriyanto to confirm the meeting. However, phone calls and text messages were not answered. Nur Kholis, a TGPF member who took part in the meeting, did not dismiss the information related to the red book.
"So that was a word. Throwing in the discussion, in my opinion, is normal, ”said Nur Kholis when met by the team IndonesiaLeaks.
A different condition actually emerged when the TGPF Team submitted its final report on June 17, 2019. The red book case that was mentioned at the TGPF meeting with the KPK was not on the list of cases suspected of being connected to the attack on Novel. According to Nur Kholis, TGPF has asked for information from the police and witnesses involved in the red book case. However, from the tracing process, TGPF did not find a relationship between these two different cases.
"The case has been processed, then the case is considered unrelated. The logic of the sequel case is not met, it is not as strong as other cases, ”he repeatedly assured the team IndonesiaLeaks.
Six other cases that are suspected of being the motive for a counterattack against Novel, include the corruption case of the Chief Justice of the Constitutional Court (MK) Akil Mochtar, the corruption of the Secretary General of the Supreme Court Nurhadi, the corruption of the Regent of Buol Amran Batalipu, the corruption of the athlete guesthouse and the case of theft of swallow's nest in Bengkulu - when The Novel is still a police officer.
Apart from a series of cases that Novel had handled, Nur Kholis admitted that TGPF had not been working optimally. TGPF, according to him, has not had time to explore Call Data Record (CDR), as well as the results of re-examination of the CCTV around the scene. In fact, according to the former chairman of the National Human Rights Commission (Komnas HAM), these two data sources are the main keys to finding the perpetrators.
Nur Kholis explained, the amount of CDR data that TGPF had collected reached thousands. However, his party has not found any suspicious telephone number activity in Novel's neighborhood.
"There are piles of stuff. The technical team can actually be more advanced. Then try to find another number, can't find it, ”he said.
Apart from not tracing the CDR data, TGPF has not confirmed the CCTV video footage in Novel's home environment. In fact, according to Nur Kholis, there were activities of unknown people five days and a day before Novel was attacked by violent water. Some of them even asked their neighbors about Novel's family activities. Meanwhile, two other people were seen sitting at the ablution place at the Jami 'Al-Ihsan Mosque.
"Friends of the technical team must chase this person," said Nur Kholis.
Zaenur Rahman, Researcher at the Center for Anti-Corruption Studies at Gadjah Mada University, has a different opinion. According to him, the red book is one of the cases that may be related to Novel's attack.
"What was conveyed by TGPF about cases that have been handled by Novel, there are in fact several important cases that were not mentioned. Including the case of beef imports, where there are allegations of missing records in the red book, "he told IndonesiaLeaks, Wednesday, October 16, 2019.
After TGPF completed its assignment, National Police Chief Tito Karnavian formed a technical team on Thursday, August 1, 2019. The team consisting of investigators from the National Police was tasked with solving the Novel Baswedan case for three months after the letter was signed or until 31 October 2019.
Inspector General of Police Muhammad Iqbal when asked for information about the technical team's performance was reluctant to talk much. He asked for the interview time to be postponed so that he could gather more information about the technical team's performance.
"In Karopenmas only. What are you doing head off I here. Tomorrow, in the room I At 8.00 am, ”said Iqbal briefly when met by the team IndonesiaLeaks at the Meradelima restaurant on Thursday, 19 September 2019.
Even so, the promised meeting plan for Friday, September 20, 2019 was canceled. The Head of Public Relations at the Police Headquarters stated that he was participating in other activities outside the office. Team IndonesiaLeaks has tried to confirm all findings. However, the National Police Headquarters still has not commented. (Team IndonesiaLeaks)
